The Delhi High Court has allowed India’s top crime investigating agency to appeal the dismissal of the accused in the 2G case. This decision follows a special court’s acquittal of all defendants in December 2017.
Subsequently, in March 2018, the Central Bureau of Investigation (CBI) petitioned the Delhi High Court to contest the acquittal.
On Friday, March 22, the HC allowed the CBI “leave to appeal” the clean chit given to the accused in the 2G case. Leave to appeal is permission to appeal against a decision of a court.
The HC held that there is a prima facie case that requires examination.
While dismissing the accused in the 2G case in 2017, Special CBI Judge OP Saini had said in seven years no “legally admissible evidence” was placed by the CBI before the court.
